Legal
Terms of service
Last updated 30 October 2026
These Terms of Service ("Terms") are a legally binding agreement between you and Alchemyfolio ("Alchemyfolio", "we", "us" or "our"), a business based in Edmonton, Alberta, Canada. They govern your access to and use of alchemyfolio.com, the Alchemyfolio web application, dashboards, browser and MetaTrader tools, emails and any related services (together, the "Service").
By creating an account, signing in, clicking to accept, buying a plan or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and our Refund and Payment Policy, which form part of these Terms. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old, or the age of majority where you live if that is higher, and able to form a binding contract. If you use the Service for a company or other organization, you confirm that you have authority to bind it to these Terms, and "you" includes that organization.
You may not use the Service if you are barred from doing so under the laws of Canada or any other applicable jurisdiction, or if we have previously suspended or closed your account.
2. Not financial advice
Alchemyfolio is a trading journal, analytics and record-keeping tool. We are not a broker, dealer, investment adviser, portfolio manager or financial planner, and we are not registered with the Alberta Securities Commission, the Canadian Investment Regulatory Organization or any other securities or financial regulator.
Nothing in the Service, including statistics, scores, insights, playbooks, calculators, the economic calendar, AI assistant answers, emails or support replies, is financial, investment, trading, legal or tax advice, or a recommendation or solicitation to buy, sell or hold any financial instrument. All content is general information only.
You alone are responsible for your trading and investment decisions and their results. You should get independent advice from a qualified and registered professional before making any financial decision.
3. Trading risk
Trading foreign exchange, contracts for difference, futures, options, cryptocurrencies and other leveraged products carries a high level of risk and may not be suitable for you. You can lose some or all of your money, and with leverage you can lose more than you deposit. Past performance, including anything shown in your journal, statistics or reports, does not indicate or guarantee future results.
Tools such as the position size calculator, risk figures, pip values and exchange rates are estimates. They may be delayed, rounded or wrong and may differ from your broker's figures. Always confirm sizes, prices and risk with your broker before placing a trade. We are not responsible for any trading loss, missed opportunity or other outcome resulting from your use of or reliance on the Service.
4. Your account
You must give accurate and complete information and keep it up to date. You are responsible for keeping access to your email and any authenticator app secure, and for everything that happens under your account. Tell us immediately at hello@alchemyfolio.com if you believe your account has been accessed without your permission.
Each account is personal to one person. You may not share, sell, transfer or rent your account or a paid plan, or let anyone else use it.
5. Broker and platform connections
You may connect trading accounts through MetaTrader, cTrader, our Expert Advisor, statement imports or other methods. You must only connect accounts you own or are authorized to connect, and only use read-only (investor) credentials where we ask for them. You confirm that connecting an account does not breach your agreement with your broker or prop firm.
Connections rely on third-party providers and platforms that we do not control. We do not guarantee that any connection, sync or import will be available, complete, accurate, timely or uninterrupted, and we are not responsible for errors or changes made by brokers, platforms, prop firms or connection providers. You remain responsible for checking your records against your broker's official statements.
6. Plans, payments and access
The Service offers a free plan and paid plans (currently Pro and Elite). Paid plans are sold as one-time payments that give access to the paid features for a fixed period, such as 30 days or 12 months, as shown at checkout. Paid plans do not renew automatically and you will not be charged again unless you choose to buy more time.
Payments are processed by Whop, our payment provider and merchant of record, under Whop's own terms and privacy policy. We do not receive or store your full card details. Prices are shown in the currency displayed at checkout and may exclude taxes, which are added where required, including Canadian GST or HST. You are responsible for any bank, currency conversion or other fees charged by your payment provider.
Your access period starts when your payment is confirmed. If you buy more time while a paid plan is active, the remaining days carry over. We may change prices, plan features and limits at any time. A price change does not affect a period you have already paid for.
All payments are final and non-refundable except as stated in our Refund and Payment Policy or where a refund is required by law. If you start a chargeback or payment dispute without first contacting us, we may suspend your paid access and your account while the dispute is open, and close the account if the dispute is resolved in your favour without good reason.
7. Free plan, trials and promotions
We may offer the free plan, trials, discounts, promotional codes or complimentary access at our discretion. We may change, limit or end them at any time. Promotions have no cash value and cannot be combined unless we say so.
8. Your content
"Your Content" means the trades, notes, tags, screenshots, playbooks, journal entries, messages and other information you upload, import, sync or create in the Service. You keep ownership of Your Content.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, display and back up Your Content only as needed to provide, secure, support and improve the Service, to comply with law and to enforce these Terms. We may also create and use anonymized, aggregated data that does not identify you for analytics, research, benchmarks and product improvement, and we own that aggregated data.
You confirm that you have all rights needed to provide Your Content and that it does not break any law or anyone else's rights. You are responsible for keeping your own copy of anything important to you. You can export your trades as CSV at any time while your account is open.
9. Acceptable use
You agree not to: break any law or regulation; upload anything unlawful, infringing, harmful or misleading; use the Service to provide signals, advice or managed trading to others for payment; access or try to access another person's account or data; probe, scan, test or bypass our security or limits; copy, scrape, crawl or harvest the Service or its data by automated means; reverse engineer, decompile or try to extract our source code except where the law expressly allows it; interfere with or overload the Service; resell, sublicense, frame or white-label the Service; use the Service to build a competing product; or misrepresent results produced by the Service, including presenting edited or demo results as real trading performance.
We may investigate breaches and suspend or remove content or accounts, and may report unlawful activity to the authorities.
10. AI assistant and support
The AI assistant gives automated answers that may be incomplete or wrong. It is provided for convenience only and is not advice. Chat conversations may be kept for up to 30 days and read by our team to help you and improve the Service.
11. Third-party services
The Service relies on and links to third-party services, including Whop, MetaApi, Spotware cTrader, Google and Firebase, email, hosting, translation and exchange-rate providers. Your use of third-party services is governed by their own terms and policies. We are not responsible for third-party services, their availability or their content.
12. Our intellectual property
The Service, including its software, design, text, graphics, logos, the Alchemyfolio name and Alchemyfolio Score, and all related intellectual property, belongs to us or our licensors and is protected by Canadian and international law. Subject to these Terms, we give you a limited, personal, revocable, non-exclusive and non-transferable licence to use the Service for your own trading records. All rights not expressly granted are reserved.
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose without paying or crediting you.
13. Changes and availability
We may change, add or remove features, limits, integrations or any part of the Service, and may suspend or end the Service, at any time. We aim to give reasonable notice of material changes affecting paid plans. We do not promise that the Service will be available at all times, error-free, secure or free from data loss. Maintenance, outages and provider issues may occur.
14. Suspension and termination
You may stop using the Service and delete your account at any time in Settings. Deleting your account permanently removes your data as described in the Privacy Policy and ends any paid access without a refund.
We may suspend or close your account, or limit your access, at any time with or without notice if we reasonably believe you have breached these Terms, created risk or possible legal exposure for us or others, engaged in fraud or abuse, or if we are required to by law. If we close your account for convenience and not for your breach, we will refund the unused portion of any paid period on a pro-rata basis.
Sections that by their nature should survive termination, including sections 2, 3, 6, 8, 12 and 15 to 21, survive.
15. Disclaimer of warranties
To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available", with all faults and without warranties, representations or conditions of any kind, whether express, implied, statutory or otherwise, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, title, non-infringement, accuracy and availability. We do not warrant that the Service will meet your needs, that data, statistics or calculations will be accurate or complete, or that any defect will be corrected.
16. Limitation of liability
To the fullest extent permitted by law, Alchemyfolio and its owners, directors, officers, employees, contractors, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any trading or investment loss, loss of profits, revenue, savings, data, goodwill or opportunity, or cost of substitute services, arising out of or relating to the Service or these Terms, however caused and under any theory of liability, including contract, tort (including negligence), breach of statutory duty or otherwise, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) CAD $100.
These limits apply even if a remedy fails of its essential purpose, and form an essential basis of the bargain between you and us.
17. Indemnity
You agree to indemnify, defend and hold harmless Alchemyfolio and its owners, directors, officers, employees, contractors and agents from and against all claims, demands, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising out of or relating to your use of the Service, Your Content, your trading, your breach of these Terms or your breach of any law or third-party right.
18. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before starting any proceeding, you agree to contact us at hello@alchemyfolio.com and try in good faith to resolve the dispute informally for at least 30 days.
Subject to any non-waivable rights you have under the consumer protection laws of the place where you live, you and we irrevocably submit to the exclusive jurisdiction of the courts of the Province of Alberta sitting in the Judicial Centre of Edmonton, and waive any objection to that venue. To the extent permitted by law, any claim must be brought individually and not as a plaintiff or class member in any class, collective or representative proceeding, and must be started within one year after the claim arose, after which it is permanently barred.
19. Consumer rights
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that you have under applicable consumer protection legislation and that cannot lawfully be excluded, restricted or modified, including the Consumer Protection Act (Alberta). Where such legislation applies, our liability is limited to the extent that legislation permits.
20. Changes to these Terms
We may update these Terms at any time. The updated version takes effect when posted on this page, and the "Last updated" date will change. For material changes we will make reasonable efforts to notify you by email or in the app before they take effect. If you continue to use the Service after changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
21. General
These Terms, together with the Privacy Policy and the Refund and Payment Policy, are the entire agreement between you and us about the Service and replace any earlier agreements or statements. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in full effect. Our failure to enforce any right is not a waiver of it.
You may not assign or transfer these Terms without our written consent. We may assign or transfer them, including in a merger, acquisition or sale of assets, without your consent. Nothing in these Terms creates a partnership, employment, agency or fiduciary relationship.
We are not liable for any delay or failure caused by events beyond our reasonable control, including outages of internet, hosting, payment or broker providers, natural disasters, labour disputes, government action, cyber attacks and pandemics.
You agree that we may give you notices and enter into this agreement electronically, and that electronic records and acceptance satisfy any requirement that they be in writing, in accordance with the Electronic Transactions Act (Alberta). We may send notices to the email on your account and you may send notices to hello@alchemyfolio.com.
The parties have requested that these Terms and all related documents be drawn up in English. Les parties ont exigé que ces conditions et tous les documents connexes soient rédigés en anglais.
